Terms of Use

What you may and may not do with Learning Game Studio.

These Terms of Use govern your use of Learning Game Studio, provided by Blue Elephants Solutions Pte. Ltd., 160 Robinson Road, #14-04 Singapore Federation Centre, Singapore 068914.

By using the service you accept these terms. If you are using it on behalf of a school, company or other organisation, you confirm you are authorised to accept them for that organisation.

The service is currently offered as Early Access. Our Early Access Terms apply in addition to these terms and take precedence where they specifically address the pre-release nature of the service.

1. What the service does

Learning Game Studio uses artificial intelligence to generate interactive learning games from a description you write and, optionally, documents you upload. You can publish a game and share it with learners by link or QR code.

2. Your account

Accounts are created by signing in with Google or Microsoft. We do not store your name or your email address — only a one-way identifier derived from your sign-in. You are responsible for keeping access to your sign-in account secure, and for everything done through your account.

You must be at least 18 years old to hold an account. Learners who play a published game do not need an account and never sign in.

3. Acceptable use

You must not use the service to create, generate, upload, publish, distribute or attempt to produce any content or outcome that:

  • is unlawful under any law that applies to you or to us, or that facilitates unlawful activity;
  • sexualises, endangers, exploits, grooms or is otherwise harmful to children, or depicts a minor in a sexual or abusive context;
  • harasses, bullies, threatens, defames, or incites hatred or violence against any person or group, including on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation;
  • promotes, glorifies or provides instruction for terrorism, violent extremism, self-harm, suicide, or eating disorders;
  • provides instructions for weapons, explosives, hazardous chemical or biological agents, or for circumventing safety systems;
  • presents medical, legal, financial, safety-critical or regulatory information as authoritative professional advice;
  • infringes anyone's intellectual property, privacy, publicity or contractual rights;
  • contains personal data about identifiable people without a lawful basis for processing it, and in particular special-category data such as health, biometric, religious or political information;
  • impersonates any person or organisation, or misrepresents your affiliation with one;
  • contains malware, or attempts to attack, overload, probe or gain unauthorised access to the service or to anyone else's data;
  • is designed to circumvent the safety policies or usage limits of the AI providers we rely on, including by disguising a prohibited request; or
  • resells, sublicenses or systematically extracts the service or its generated output as a competing product.

We would rather this list were too broad than too narrow. If something you want to do sits close to a line, ask us first at contact@blue-elephants-solutions.com.

4. AI-generated content, and your responsibility for it

Games are generated by artificial intelligence. AI is probabilistic and can produce content that is inaccurate, incomplete, biased, outdated or unsuitable.

You are responsible for reviewing every game before you publish it or put it in front of learners. Where a game covers sensitive, regulated, safety-critical, medical or legal subject matter, a suitably qualified person must review it first. We do not warrant that generated content is accurate or fit for any particular purpose.

5. Your content and your rights

You keep the rights you already hold in the descriptions, documents and images you provide, and in the games generated for you. You grant us the licence needed to operate the service — to store your content, to send it to the AI providers listed in our Privacy Policy so a game can be generated, and to display games you choose to publish.

You confirm you have the rights and permissions needed for everything you upload.

6. Using your games commercially

On every plan, you may use the games you create to teach within your own organisation — your classroom, your students, your colleagues, and your internal training.

Using games to make money requires a commercial-use licence, which is included in the University / Business plan. With it, you may sell your games or charge money for access to them, and you may use them to train people outside your own organisation — for example in paid courses or training you deliver to third parties. The licence covers every game created in that workspace, whoever in the workspace made it.

Publishing a game that anyone can play for free is not commercial use, on any plan. If you are not sure whether something you plan counts as commercial use, ask us at contact@blue-elephants-solutions.com.

7. Publishing

Publishing a game creates a stable link that anyone holding it can open, without signing in. A game published as public is additionally listed in the public gallery.

On the free plan, published games are public. If you need a game to stay unlisted, use a paid plan.

You may report a public game you consider inappropriate. We may unlist or remove any game that breaches these terms, and may suspend or close accounts that do so repeatedly or seriously.

8. Credits and plans

Building games consumes credits. Failed builds are not charged. Credits are not money, cannot be exchanged for money, and expire in line with the plan they were granted under. Plan details and prices are shown on the Plans page and may change; changes will not apply retrospectively to a period already paid for.

9. Availability

We aim to keep the service available but do not guarantee uninterrupted or error-free operation. During Early Access in particular, features may change or be withdrawn.

10. Liability

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Subject to that, and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from your use of AI-generated content that you did not review. Our total liability in any twelve-month period is limited to the amount you paid us in that period.

11. Ending your use

You may stop using the service at any time and delete your account and its data from Settings. We may suspend or end access where these terms are breached, or where required by law.

12. Changes

We may update these terms. Where a change is material we will give notice in the app or by another reasonable means, and where the law requires it we will ask you to accept the new version.

13. Governing law and contact

These terms are governed by the laws of Singapore, without prejudice to mandatory consumer protections available to you where you live.
